
Pagoh Cashera Sdn. Bhd. – Loan Facility Terms & Conditions
The following terms and conditions apply to the loan facility provided by Pagoh Cashera Sdn. Bhd. (Registration No.: WL8084/01/01-2/271226). These terms are supplemental to the Moneylending Agreement entered into between Pagoh Cashera and you as the Borrower. By accepting the loan offered, you confirm that you have read, understood, and agreed to be bound by these terms and conditions.
The name submitted by you must match the name stated in your identification documents. The loan purpose is limited to personal or business use only. Once the loan amount, tenure, instalment amount, and repayment date have been confirmed, no amendments will be allowed. All verbal and written communications with Pagoh Cashera’s representatives may be recorded for verification and documentation purposes. You are required to notify Pagoh Cashera in writing if there are any changes to your employment details, business information, residential address, or contact information. If you plan to leave Malaysia for more than thirty consecutive days, you must inform Pagoh Cashera in advance in writing. You acknowledge that the repayment method and instructions have been clearly explained to you.
All repayments must be made to Pagoh Cashera at the payment address or through any authorised payment channel officially notified to you. Payments made through postal or third-party services are at your own risk until received by Pagoh Cashera. You are required to make monthly instalment payments throughout the agreed loan tenure until the loan, interest, and all related charges have been fully settled. Instalments remain payable even if you do not utilise or withdraw the loan funds released to you. If there is any delay in making payment, Pagoh Cashera reserves the right to contact you through your mobile, home, or office number, or to conduct a house visit to the address you have provided. If you fail to make instalment payments or are unable to continue repayment, Pagoh Cashera may require an additional guarantor or may terminate the agreement without any liability for damages. A late payment interest of 8% per annum will be imposed on overdue amounts, calculated from the date of default until full settlement. Pagoh Cashera reserves the right to appoint an authorised collection agent to recover any outstanding sums due.
If you wish to settle the loan earlier than the agreed tenure, you must provide Pagoh Cashera with thirty days’ written notice. Early settlement will be subject to any applicable early termination fees as specified in your offer letter.
These terms and conditions shall be governed by the laws of Malaysia. If these terms are translated into any language other than English and any inconsistency arises, the English version shall prevail. Pagoh Cashera shall not be liable for any losses, claims, damages, costs, or expenses that you may incur arising from or relating to your acceptance of the loan. You consent to receive promotional messages, emails, mailers, and calls from Pagoh Cashera regarding services and updates. These terms and conditions shall be binding upon your heirs, personal representatives, successors, and permitted assigns. If any part of these terms is deemed illegal, invalid, or unenforceable, such part will be ineffective only to that extent and will not affect the validity of the remaining provisions. No variation or amendment to these terms shall be effective unless made in writing and signed by all parties involved.
You shall be responsible for all related legal fees, stamp duties, Commissioner for Oaths fees, caveat lodgement fees (if applicable), and any other necessary charges associated with the preparation and processing of the loan agreement.
